Discount code terms and conditions

1. GENERAL PROVISIONS

1. These terms and conditions (the "Terms") set out the general conditions, rules and manner of using discount codes entitling the holder to purchase at a discount in the online shop operating at ministerstwo.pl (the "Shop") and in the Ministerstwo Dobrego Mydła physical shops.
2. The owner of the Shop and the organiser of promotional campaigns using discount codes is Bielun & Bielun sp. z o.o., with its registered office at ul. Sosnowa 6c, 71-468 Szczecin, Poland, VAT ID (NIP): 8513223904, REGON: 369533555, KRS: 0000729322, share capital PLN 34,500, hereinafter the "Organiser".
3. Discount Codes may be made available by the Shop as part of its marketing activities and promotional campaigns, through the newsletter, social media, or provided to Customers individually.

2. DEFINITIONS

1. Discount Code - a unique string of alphanumeric characters or words which, when entered in the shopping basket, causes a discount to be applied on the terms set out in these Terms or in the description of a given promotional campaign.
2. Regular price - the standard gross retail price of a product, without taking into account any other reductions, discounts or promotions, applicable in the Shop at the time the order is placed.
3. Customer - a natural person with full legal capacity and, in the cases provided for by generally applicable law, also a natural person with limited legal capacity, a legal person or an organisational unit without legal personality to which the law grants legal capacity - who has concluded or intends to conclude a sales agreement with the Organiser.
4. Goods - a product offered for sale by the Organiser in the Shop or in the Ministerstwo Dobrego Mydła physical shops.

3. RULES FOR USING DISCOUNT CODES

1. A Discount Code may be used only when placing an order in the Shop or when shopping in one of the Organiser's physical shops.
2. In order for the discount arising from a Discount Code to be applied, the Customer must enter the code in the field provided for that purpose in the basket, before finalising the order and confirming the purchase. In a physical shop, the Customer gives the code to the shop staff. Discounts are not applied retrospectively to orders already placed or paid for.
3. Discount Codes have a specified validity period. After that period the code expires and cannot be reactivated or used.
4. A Discount Code may be single-use or multiple-use, as stated each time in the information accompanying the code.
5. The use of some Discount Codes may be conditional on reaching a minimum order value, specified each time in the information accompanying the Code.
6. A Discount Code provided to a Customer in exchange for subscribing to the Shop newsletter is single-use and may be used only on the first order placed by that Customer.
7. Discount Codes issued as part of cooperation with affiliate partners, online creators or partner campaigns may be subject to separate rules set out in the information accompanying the Code.
8. All Discount Codes distributed by the Shop apply solely to regular prices and cannot be combined with any other promotions, sales or price reductions applicable in the Shop, unless the terms of another promotion provide otherwise.

4. LIMITATIONS AND EXCLUSIONS

1. No combining of promotions - discounts arising from the use of Discount Codes are not cumulative with other reductions, coupons, time-limited promotions, promotional sets or products from the "Outlet" and "Short expiry date" sections. A Discount Code also cannot be combined with the permanent discount arising from a tier in the loyalty programme - in that case a single discount, the one more favourable to the Customer, is applied.
2. Excluded products - Discount Codes cannot be used to purchase the following products:
   1. gift vouchers,
   2. skincare accessories,
   3. home accessories,
   4. COUCOU SUZETTE® hair accessories,
   5. samples.
3. Where the Customer's basket contains both Goods at the regular price and Goods covered by another promotion (e.g. reduced items), the Discount Code reduces only the price of the Goods at the regular price. Goods covered by another promotion remain at the promotional price and are not covered by the discount arising from the Code.
4. Discount Codes do not reduce the delivery costs of an order. Shipping costs are calculated in accordance with the Shop's price list.
5. Discount Codes cannot be exchanged for money (cash), a monetary equivalent or gift vouchers.
6. The Organiser reserves the right to exclude certain products or product categories (e.g. gift vouchers, gift sets or new arrivals) from the possibility of using Discount Codes on them.
7. Discount Codes intended for individual Customers do not apply to orders placed under the Shop's B2B offer, unless the information accompanying the Code provides otherwise.
8. Prevention of abuse - the Organiser reserves the right to invalidate a Discount Code and to refuse to fulfil an order where abuse is found, in particular:
   1. repeated use of a single-use Code by the same Customer, including by creating multiple accounts in the Shop,
   2. resale or commercial distribution of the Code without the Organiser's consent,
   3. obtaining the Code unlawfully or in breach of the terms of the promotional campaign under which the Code was issued.

5. REDEEMING A DISCOUNT CODE

1. To use a discount in the online Shop, once the basket has been assembled, enter the Discount Code in the discount code field and confirm. The discount applied is visible in the order summary before the order is placed.
2. To use a discount in the Organiser's physical shops, inform the shop staff of your wish to use the discount and give the Discount Code before the receipt is finalised.
3. The VAT invoice is issued for the amount actually paid by the Customer, that is after the discount arising from the Discount Code has been applied.

6. COMPLAINTS AND RETURN OF GOODS

1. All returns or complaints concerning Goods purchased using a Discount Code are handled on the general terms set out in the Shop's terms and conditions.
2. In the case of withdrawal from an agreement (return of Goods) purchased using a Discount Code, the Customer is refunded the amount they actually paid, that is the price of the Goods after the reduction arising from the use of the Code.
3. Where a partial return of Goods causes the value of the Goods remaining in the order to fall below the minimum order value required to use the Discount Code, the Organiser reserves the right to recalculate the order value without the discount. In such a case the refund will be reduced by the value of the discount originally applied.
4. Complaints concerning the operation of Discount Codes (e.g. a Code that cannot be used, an incorrectly calculated discount) may be submitted by the Customer to [email protected]. The complaint should contain the Customer's details, the Discount Code and a description of the problem. The Organiser will consider the complaint within 14 days of receiving it.

7. FINAL PROVISIONS

1. Using a Discount Code constitutes acceptance of these Terms.
2. These Terms are made available on the Organiser's website, in the "Terms and conditions" section.
3. The processing of Customers' personal data in connection with the issue and redemption of Discount Codes takes place on the terms set out in the Organiser's Privacy Policy, available in the Shop.
4. Any matters not regulated by these Terms are governed by the Shop's main terms and conditions and by generally applicable provisions of Polish law, in particular the Act of 23 April 1964, the Civil Code, and the Act of 30 May 2014 on Consumer Rights.
5. The Organiser reserves the right to amend these Terms for important reasons (e.g. changes in the law, technical changes in the operation of the Shop). Amendments enter into force when published on the Shop's website and do not apply to Discount Codes issued to Customers before the amendment.
