Gift voucher terms and conditions

1. GENERAL PROVISIONS

  1. These terms and conditions (the "Terms") set out the rules for purchasing and redeeming gift vouchers in the online shop at ministerstwo.pl and in the physical shops of Ministerstwo Dobrego Mydła (ul. Dzielna 15, 01-029 Warszawa; ul. Niemierzyńska 29a, 71-436 Szczecin, Poland).
  2. The issuer of the gift vouchers is Bielun & Bielun sp. z o.o. with its registered office in Szczecin, ul. Sosnowa 6c, 71-468 Szczecin, Poland, entered in the register of entrepreneurs of the National Court Register kept by the District Court Szczecin-Centrum in Szczecin, 13th Commercial Division of the National Court Register, under KRS number: 0000729322, VAT ID (NIP): 8513223904, REGON: 369533555 (the "Issuer").
  3. In matters not regulated by these Terms, the provisions of the online shop terms and conditions apply.

2. DEFINITIONS

  1. Gift voucher - a voucher of a specified face value, issued to bearer, in the form of an alphanumeric code delivered electronically or on paper, entitling the User to pay for Goods in the Issuer's online shop and physical shops.
  2. Code - the unique number assigned to a Gift voucher, required in order to redeem it.
  3. Purchaser - the person who acquires a Gift voucher from the Issuer in exchange for money.
  4. User - the Purchaser or any current holder of the Gift voucher.
  5. Balance - the current, unused value of the Gift voucher.
  6. Goods - items offered for sale in the Issuer's online shop and physical shops.

3. PURCHASING A GIFT VOUCHER

  1. Gift vouchers may be purchased in the Issuer's online shop and in its physical shops.
  2. Gift vouchers are available in the following denominations: [NOMINALY - do uzupelnienia zgodnie z kombinacjami produktu].
  3. The Purchaser undertakes to pay the Issuer an amount equal to the face value of the Gift voucher.
  4. A Gift voucher purchased in the online shop is delivered electronically, to the e-mail address given in the order, promptly after the order has been paid for. For this reason, not all payment methods are available for an order containing a Gift voucher - in particular, cash on delivery is not available. The payment methods available are presented while the order is being placed.
  5. A Gift voucher purchased in a physical shop is issued on paper or electronically.
  6. The value of a Gift voucher does not count towards the free delivery threshold - a Gift voucher therefore does not cause the remaining Goods in the order to be delivered free of charge.
  7. The purchase of a Gift voucher is not covered by the loyalty programme and does not entitle the Purchaser to any Points.

4. VALIDITY PERIOD

  1. A Gift voucher is valid for 12 (twelve) months from the day the payment for the Gift voucher is credited to the Issuer's bank account. The expiry date is stated on the Gift voucher in the format DD-MM-YYYY.
  2. After the expiry date, a Gift voucher can no longer be redeemed and any unused Balance is forfeited. The Issuer has the right to refuse to accept a Gift voucher after its expiry date.
  3. The validity period of a Gift voucher is not extended by its partial use. The remainder referred to in point 6 keeps the validity period of the original Gift voucher.

5. REDEEMING A GIFT VOUCHER

  1. In the online shop: enter the Code in the discount code field in the basket or while placing the order and confirm it. The value of the Gift voucher will be deducted from the order amount.
  2. In a physical shop: the User presents the Gift voucher at the till before the transaction is completed.
  3. Any combination of Gift vouchers and other payment methods may be used for a single order.
  4. If the value of the Goods exceeds the Balance of the Gift voucher, the User pays the difference using any available payment method - in the online shop in accordance with the shop terms and conditions, and in a physical shop in cash or by payment card.
  5. A Gift voucher may be redeemed only in the currency in which it was issued. A voucher issued in Polish zlotys cannot be used to pay for an order settled in another currency.
  6. A Gift voucher does not cover the costs of delivery of the Goods, which the User pays when placing the order.
  7. Any Goods from the Issuer's range may be purchased using a Gift voucher.

6. REMAINDER OF A GIFT VOUCHER

  1. If the value of the Goods is lower than the Balance of the Gift voucher, the unused part is not forfeited. The User receives a Gift voucher for the remaining amount, which may be used for further purchases.
  2. The remainder is issued solely in the form of a Gift voucher. The Issuer does not give change in cash or in any other monetary form.
  3. A Gift voucher issued for the remainder keeps the validity period of the original Gift voucher, in accordance with point 4.3.
  4. A User who holds an account in the online shop will find the current Balance of their Gift vouchers and the history of their use after logging in, in the "Your account" section.

7. LIMITATIONS

  1. A Gift voucher cannot be exchanged for money (cash), in whole or in part.
  2. A Gift voucher is issued to bearer. The Issuer is not liable for a Gift voucher being made available to unauthorised persons by the Purchaser or the User.
  3. Neither the Purchaser nor the User has any claims against the Issuer arising from the loss, including theft, or destruction of a Gift voucher after it has been handed over.
  4. Within the meaning of applicable law, a Gift voucher is not an electronic payment instrument or an electronic payment card. A Gift voucher is an electronic or paper form of a goods voucher.

8. WITHDRAWAL FROM THE AGREEMENT, RETURNS AND COMPLAINTS

  1. The purchase of a Gift voucher in the online shop is subject to the right of withdrawal from a distance agreement, on the terms set out in the online shop terms and conditions.
  2. Using a Gift voucher before the expiry of the withdrawal period is equivalent to waiving the right to withdraw from the agreement for its purchase. Using a Gift voucher in the period between submitting a declaration of withdrawal and delivering the returned voucher to the Issuer is equivalent to revoking that declaration and means that the Issuer is not obliged to refund the purchase price of the voucher.
  3. Where Goods purchased using a Gift voucher are returned, the refund is made in the form of a Gift voucher for the value of the Goods returned. This provision does not limit the consumer's rights arising from mandatory provisions of law, in particular the right to a refund of payments upon withdrawal from a distance agreement.
  4. The User may also exchange Goods purchased using a Gift voucher:
    1. for other Goods of the same value,
    2. for Goods of a lower value, without a refund of the difference in price,
    3. for Goods of a higher value, after paying the difference in price.
  5. Returns, exchanges and complaints relating to the purchase of Gift vouchers and of Goods purchased using them are handled in accordance with the procedure described in the online shop terms and conditions.

9. TAX SETTLEMENT

  1. The issue of a Gift voucher constitutes a sale subject to value added tax within the meaning of applicable tax law.
  2. Upon purchasing a Gift voucher, the Purchaser receives a fiscal receipt or a VAT invoice from the Issuer.

10. FINAL PROVISIONS

  1. Upon receiving a Gift voucher, the Purchaser and the User declare that they have read these Terms, accept them in full and undertake to comply with their provisions.
  2. These Terms are available in the online shop at ministerstwo.pl and in the Issuer's physical shops.
  3. In matters not regulated by these Terms, the relevant applicable provisions of Polish law apply.
  4. These Terms enter into force on [DATA WEJSCIA W ZYCIE - do uzupelnienia].
